PRIVACY AND COOKIES POLICY

I. GENERAL PROVISIONS

1. The controller of personal data collected through the website www.galeriajasnikowski.pl is Artistic publishing house "Lux Artis" established in Henryków Lubański 370; 59-800 Lubań entered in the Register of Entrepreneurs under number: NIP: 6131500568, REGON: 020649400; e-mail address: kontakt@galeriajasnikowski.pl

         hereinafter referred to as "Administrator", being also the Service Provider.

2. If you have any doubts or wish to exercise your rights, please contact our Personal Data Administrator (ADO) at the email address: kontakt@galeriajasnikowski.pl 

3. Your personal data is processed in accordance with the Personal Data Protection Act of 29 August 1997 (Journal of Laws 2016, item 922) and the Act on Providing Electronic Services of 18 July 2002 (Journal of Laws No. 144, item 1204 as amended), the current Personal Data Protection Act of 10 May 2018. (Warsaw dn. 24.05.2018, Journal of Laws 2018, item 1000).

4. Your personal data is also processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO / GDPR).

5. It takes special care to protect the interests of data subjects and in particular ensures that the data it collects are:

• processed in accordance with the law,
• collected for specified, legitimate purposes and not further processed in a way incompatible with those purposes
• Substantially correct and adequate in relation to the purposes for which they are processed and kept in a form which permits identification of data subjects for no longer than is necessary to achieve the purpose of the processing.

II. PURPOSE AND SCOPE OF DATA COLLECTION AND LEGAL BASIS FOR THESE ACTIVITIES

1. Your personal data is processed for two purposes:- to respond to your enquiries via the contact form, email or telephone contact - the legal basis for this is the principle that processing is permitted if it is necessary for the performance or conclusion of a contract.

         - sending offers and other marketing and promotional content - the legal basis for these activities is your consent.

2. The website has an informational and sales function, the database engine does not contain any mechanisms to collect data about the website user.

3. You are not profiled, which means that your data is not processed in an automated manner to determine (estimate) your needs or personal characteristics. We do not collect additional information about you from other sources.

4. We do not sell your personal data, nor do we share it with other parties. In particular, your data is not transferred outside the European Economic Area or to international organisations.

III. STORAGE AND DELETION OF DATA

1. We endeavour to limit as much as possible the retention period of personal data that is no longer used. However, we would like to inform you that this may occur for operational and technological reasons. By this we mean the time it takes to decide whether further contact is advisable, as well as the time it takes to delete data from the security copy.

2. Your data processed for the purpose of handling your enquiry will be processed with us for the duration of the correspondence and then, depending on the outcome, will either be added to our customer base and further processed for the purpose of fulfilling the contract, or will be deleted if there is no possibility of cooperation.

3. In the event of a clear closure of the discussions on your part, the data will be deleted immediately from the working system databases and from the security copies before thirty days have elapsed.

4. If there is no response and the situation is unclear, the data will be kept for a period of 3 months from the date of the last message.

5. Data processed on the basis of consent, i.e. data used to send marketing information, will be processed until consent is withdrawn. You should also add the period of 45 days needed for us to remove them from the security copy.

IV. THE RIGHT TO WITHDRAW CONSENT, THE RIGHT TO CONTROL, ACCESS AND RECTIFY YOUR DATA, THE RIGHT TO DATA PORTABILITY, THE RIGHT TO OBJECT TO FURTHER PROCESSING AND THE RIGHT TO LODGE A COMPLAINT WITH A SUPERVISORY AUTHORITY

1. We notify you that we process your data for marketing purposes on the basis of your voluntary consent. We notify you that this consent can be withdrawn at any time. We suggest that you send us a message to this effect from the same e-mail address or telephone number to which you receive marketing content. The sole consequence of withdrawing your consent will be that you will no longer be able to receive information from us about our offer and other marketing content. We would also like to notify you that withdrawal of consent does not affect the lawfulness of our processing of your data that took place prior to this withdrawal.

2. You have the right to access and correct your personal data.

3. If you find yourself in a special situation which makes the further processing of your data by us jeopardise your privacy, you can notify us and call on the  to cease or restrict processing.

4. You also have the right to request us to send your data to another entity in a form that the recipient can freely process. We would like to notify you that this right only applies to data that we have received from you. Given that the exclusive data we process about you is in text form, the transfer of data will come down to us generating text documents in PDF format containing the history of your requests. These documents will not contain our responses and therefore in particular our advice or other expertise, as this is not subject to your entitlement (not transferable).

6. We notify you that you also have the right to lodge a complaint with a supervisory authority. This is currently the Inspector General for Personal Data Protection. National legislation, the entry into force of which is necessitated by a change in the law at European level (RODO), will determine in detail who will be the legal successor of the GIODO. It is likely to be the President of the Data Protection Authority, and the new office will be established on 25 May 2018.

V. COOKIES

1. The website of the Service Provider uses "cookies". If the Client does not change the settings of his/her browser, this is tantamount to consenting to their use.

2. The installation of "cookies" is necessary for the correct provision of services on the website. Cookies contain information necessary for the proper functioning of the website, in particular those requiring authorisation.

3. Types are used within the website:

            a) sessional

            b) "Session" cookies are temporary files which are stored on the device. the Customer's terminal equipment until the Customer logs out (leaves the website).

4. The user has the right to decide on the access of cookies to his/her computer by selecting them in advance in his/her browser window.  Detailed information on the possibility and handling of cookies is available in the settings of your software (web browser).
